Government: a new condition for insurance introduced and the first PPP project approved

At its session on 26 June, the Government approved an amendment to the Insurance Act (zákon o pojišťovnictví). According to the amendment, a new condition for insurance rating has been introduced. The amendment stipulates that the gender should not influence the insurance rating. An exception from equal treatment has been employed so far. According to the judicial review of the ECJ (C – 236/09 Test-Achats), the unequal treatment, based on the gender, should be abandoned. The directive of the EU applies to new insurance contracts agreed after 21 December, 2012 (therefore, no changes for current contracts). The amendment to the Insurance Act transposes the EU directive. The amendment enables unequal treatment of insurance rating resulting from different age and health state.
The amendment is heading to the Chamber of Deputies.
